My Turn Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the My Turn website, platform, applications, communications, and transportation services (collectively, the “Services”).

By accessing or using My Turn Services, you agree to be bound by these Terms, the My Turn Privacy Policy & Cookies Policy, the My Turn Zero Tolerance & Conduct Policy, and related operational policies incorporated by reference.

If you do not agree to these Terms, you should not access or use My Turn Services.

1. Service Overview

My Turn provides pre-scheduled, non-emergency transportation services for school-aged children between verified locations, including without limitation, schools, activity centers, and residences approved by parents / guardians and verified by My Turn.

My Turn is not an on-demand or ride-hailing transportation service. Transportation services are provided solely in accordance with structured, pre-established routes, schedules, available operational capacity, and confirmed participation enrollment. My Turn makes no guarantee of availability outside such structured parameters.

My Turn operates company-managed vehicles that are dual-staffed by trained transportation personnel.

For purposes of these Terms, “Transportation Personnel” may include, without limitation, ride captains, ride coaches, drivers, operational staff, independent contractors, volunteers, or authorized agents and representatives of My Turn.

My Turn is a transportation provider only and is not (a) a childcare or babysitting provider, (b) an emergency or medical transportation provider, (c) a school district transportation department, or (d) a transportation network company (i.e., a ride-sharing service).

To the extent related to the Services, and other than for the safe transport of child participants during the period in which a child is physically present in a My Turn vehicle and under the direct supervision of Transportation Personnel, My Turn does not assume, and expressly disclaims, any custodial, supervisory, or parental responsibility of child participants. Responsibility for the supervision, care, and safety of a child participant before pick-up and after drop-off remains solely with the child participant’s parent, guardian, or other designated responsible party.

My Turn does not provide medical, behavioral, or special needs services. Transportation Personnel are not trained or authorized to provide such services.

By using the Services, the child participant’s parent or guardian acknowledges and understands the limitations set forth herein and assumes all risks associated with any period outside of My Turn’s Services.

2. Eligibility & Account Responsibility

Accounts must be created and managed exclusively by a parent or legal guardian of the participating children. No other individual is authorized to establish or manage an account on behalf of a participant absent parental or legal guardian authorization and My Turn’s prior written consent.

By creating, accessing, or maintaining an account, you represent and warrant that you:

  • Are at least 18 years of age;

  • Have legal authority to act on behalf of the registered child(ren);

  • Will provide accurate, current, and complete information; and

  • Have not been restricted by any court order, custody arrangement, or other legal obligation from registering or making transportation decisions for the child(ren), or, if such restrictions exist, have fully complied with same and obtained all necessary consents.

Parents and guardians are responsible for maintaining accurate and complete rider information, including without limitation, rider details, medical or behavioral information relevant to transportation, emergency contact information, authorized pick-up / drop-off information, custody or access restrictions, and any applicable release authorizations or information.

The parent or legal guardian acknowledges and agrees that My Turn is entitled to rely on the information provided through the account, without independent verification, and shall have no liability for any loss, damage, delay, or misdelivery arising from inaccurate, incomplete, or outdated information; provided, however, that My Turn reserves the right, in its sole discretion, to request documentation reasonably necessary to confirm a parent’s or guardian’s authority and to suspend or terminate Services if such authority cannot be verified to My Turn’s satisfaction.

The parent or legal guardian further agrees to promptly notify My Turn of any changes to the foregoing information and acknowledges that failure to do so may result in suspension or termination of Services.

The parent or legal guardian is responsible for maintaining the confidentiality and security of account credentials and for all activity occurring under the account, whether or not authorized, and agrees to notify My Turn immediately of any unauthorized access or use.

3. Scheduling & Service Structure

All rides must be scheduled in advance through approved My Turn platforms or systems. No transportation services will be provided without a confirmed reservation.

Service availability is subject to and contingent upon several factors, including, but not limited to:

  • Structured routing, including pre-established routes and scheduling parameters;

  • Verification and approval of pick-up and drop-off locations;

  • Operational capacity, including available vehicle capacity, personnel, and operational resources;

  • Geographic service areas designated by My Turn in its sole discretion; and

  • Rider demand, routing and overall system efficiency.

My Turn Reserves the right to modify routes, schedules, pick-up and drop-off sequencing, or Service availability at any time in order to maintain safe, efficient, and reliable operations.

Pickup and drop-off times are estimates only and are not guaranteed. Actual times may vary due to circumstances out of My Turn’s reasonable control, including, without limitation, weather, traffic, road closures, mechanical issues, staffing availability, rider readiness, emergencies, delays caused by other riders, system or technology interruptions, or other operational or safety-related conditions.

MY TURN EXPRESSLY DISCLAIMS ANY GUARANTEE OF EXACT PICKUP, ARRIVAL, OR COMPLETION TIMES AND SHALL NOT BE LIABLE FOR DELAYS OR SERVICE INTERRUPTIONS EXCEPT TO THE EXTENT REQUIRED BY APPLICABLE LAW.

My Turn further reserves the right, without liability, to cancel, suspend, delay, or refuse any scheduled transportation service where, in its reasonable judgment, conditions present a safety risk, legal concern, or operational impracticability.

4. Parent & Guardian Responsibilities

Parents and legal guardians are solely responsible for the enrollment, supervision, and participation of each child and for compliance with these Terms:

Without limitation, parents and legal guardians are responsible for:

  • Providing and maintaining accurate, complete, and current rider, medical, emergency, custody, and release information;

  • Ensuring child participants are prepared for pickup at the designated time and location;

  • Maintaining and updating all accurate pick-up, drop-off, and release instructions, including authorized receiving parties and release permissions;

  • Communicating relevant medical, behavioral, custody, or safety information; and

  • Ensuring all designated pick-up and drop-off locations are safe, accessible, and legally permissible.

For home or private location drop-offs, parents or legal guardians must designate either:

  • A verified adult authorized to receive the child participant; or

  • An approved independent release authorization.

Upon completion of a verified release or authorized drop-off, all custody, supervision, and responsibility immediately transfers to the parent, guardian, or designated receiving party.

If a required receiving party is unavailable, or if Transportation Personnel determine that a drop-off cannot be safely completed, My Turn may take reasonable alternative actions, and any resulting delay, cost, or consequence shall be the responsibility of the parent or guardian to the extent permitted by law.

My Turn reserves the right to refuse, delay, modify, suspend, or deny transportation services when conditions are determined to be unsafe, information is incomplete or unreliable, or Services would create legal, safety, or operational concerns.

5. Safety & Operational Policies

My Turn maintains separate operational and safety policies governing transportation services (the “Operational Policies”).

These policies, including without limitation, the My Turn Zero Tolerance & Conduct Policy, pick-up and release procedures, cancellation policies, rider eligibility requirements, and incident response procedures, are hereby incorporated into these Terms by reference and form a binding part hereof.

Parents and guardians are responsible for reviewing and complying with all current Operational Policies as published through the official website or platforms of My Turn, as may be updated from time to time. Continued use of the Services constitutes acceptance of such policies and any modifications thereto.

6. Payments & Fees

Use of My Turn Services is contingent upon timely payment of all applicable fees associated with scheduled participation.

By enrolling in or using the Services, you authorize My Turn and its third-party payment providers to process and charge all applicable Service fees to your designated payment method and to take such actions as reasonably necessary to process payments, including recurring charges where applicable.

Specific pricing, billing terms, cancellation deadlines, credits, refunds (if any), and ride participation requirements are governed by and defined in the applicable Operational Policies, which are incorporated herein by reference. Failure to maintain a valid payment method or to remit payment when due may result in suspension or termination of Services.

7. Right to Refuse or Terminate Services

My Turn reserves the right, in its sole discretion and without liability (except to the extent required by applicable law), to refuse, suspend, restrict, or terminate transportation services or platform access at any time when reasonably necessary to protect:

  • Rider safety;

  • Staff or personnel safety;

  • Operational integrity or Service efficiency;

  • Legal compliance with applicable laws, regulations, or internal policies;

  • Security of vehicles or property; and

  • Public safety.

Nothing in these Terms shall be construed as a guarantee of Service availability, eligibility for transportation services, or continuity of participation.

8. Assumption of Risk; Waiver and Release; Limitation of Liability

To the fullest extent permitted by applicable law, the parent or legal guardian of each participant acknowledges and agrees that participation in transportation services inherently involves certain risks, including, without limitation, risks associated with vehicle transportation, loading and unloading, interactions with other passengers, and conditions beyond My Turn’s control.

Accordingly, and as a condition of participation, the parent or guardian, on behalf of themselves and the participant, knowingly and voluntarily assumes all such risks and hereby waives, releases, and discharges My Turn and its affiliates, and each of their respective officers, directors, members, managers, employees, contractors, volunteers, and agents (collectively, the “Released Parties”) from any and all claims, demands, damages, liabilities, losses, or causes of action arising out of or related to the participant’s use of the Services, except to the extent caused by the gross negligence or willful misconduct of a Released Party.

To the fullest extent permitted by applicable law, My Turn shall not be liable for indirect, incidental, consequential, or special damages, Service interruptions, delays, or events outside reasonable operational control.

Total liability, if any, shall not exceed the amount paid for applicable Services during the relevant period.

9. Indemnification

The parent or legal guardian of each child participant agrees to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, demands, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) the participant’s conduct or actions; (b) any breach of these Terms by the parent, guardian, or participant; (c) any failure by the parent or guardian to provide accurate or complete information regarding the participant; or (d) any circumstances occurring before pickup or after drop-off, including failure to ensure appropriate supervision at designated locations.

10. Governing Law

These Terms shall be governed in accordance with the laws of the State of North Carolina.

11. Updates to Terms

Updated versions will be published through the official website of My Turn with an updated “Last Revised” date.

Continued use of Services following publication constitutes acceptance of the updated Terms.
